- 2. Company Information and Application of These Terms
- Naughty Goblin Events is operated by Naughty Goblin Productions (Pty) Ltd, registration number 2026/461800/07, based in Cape Town, Western Cape, South Africa. Naughty Goblin Events operates an online event ticketing platform and may also provide merchandise sales and connected event technology services.Naughty Goblin Productions (Pty) Ltd is not currently registered for VAT.
- 2. Scope of These Terms
- These Terms govern use of the Naughty Goblin Events website and its connected ticketing services, PiP services, Check-in Consoles, check-in applications, ticket scanning and validation systems, and merchandise services.By creating an account, purchasing a ticket or merchandise, or using a connected service, you agree to these Terms together with our separate Privacy Policy, Refund & Cancellation Policy and Cookie Policy. Event-specific conditions displayed for a particular event may also apply.
- 3. Our Role and Third-Party Events
- Naughty Goblin Events may sell tickets for events organised by Naughty Goblin Productions (Pty) Ltd and for events organised by independent third-party Event Organisers.Where an event is identified as a third-party event, Naughty Goblin Events acts primarily as the ticketing and technology platform. The Event Organiser remains responsible for producing and operating the event, including the venue, programme, performers, licences, permissions, safety arrangements, event-specific rules and other operational obligations, except where Naughty Goblin Events expressly agrees otherwise.Nothing in these Terms removes any responsibility or consumer right that cannot lawfully be excluded under South African law.
- 4. Accounts and Customer Information
- Customers must provide accurate and current information when creating an account or completing a transaction. You are responsible for keeping your account credentials secure and for notifying us if you reasonably believe your account has been compromised.We may restrict or suspend access where reasonably necessary to investigate fraud, misuse, unlawful activity, security risks or a material breach of these Terms.
- 5. Ticket Purchases
- Tickets are subject to availability. A booking is confirmed only once payment has been successfully authorised and a booking confirmation or Ticket has been issued.· Check the event, date, time, venue, ticket type, quantity and other booking details before payment.· Tickets may be subject to age, capacity, seating, access or other restrictions stated on the event listing.· Tickets and their QR codes, barcodes or other credentials may not be altered, duplicated, counterfeited or used fraudulently.· A Ticket that has already been validly redeemed may be rejected if presented again.
- 6. Ticket Prices, Booking Fees and Split Payments
- The ticket price and any separate booking, service or platform fee will be disclosed before the Customer completes payment. The total amount payable will be shown at checkout.Payments are processed by approved third-party payment service providers. Where split-payment functionality is used, the payment provider may allocate the Event Organiser's ticket proceeds directly to the Event Organiser and allocate Naughty Goblin Events' agreed booking fee, commission or platform charge directly to Naughty Goblin Events.The precise settlement, processing-fee, refund and chargeback arrangements may depend on the applicable payment provider and the agreement governing the relevant event. Naughty Goblin Events will not represent itself as holding or controlling Event Organiser funds where the payment provider settles those funds directly to the Event Organiser.
- 7. Third-Party Event Organiser Responsibilities
- For third-party events, the Event Organiser is responsible for the event information supplied for publication and for delivering the event substantially as advertised, subject to lawful and reasonable changes.· The Event Organiser is responsible for event-specific licences, permissions, venue arrangements and safety requirements.· The Event Organiser is responsible for its performers, suppliers, contractors and event operations.· Event-specific enquiries may be referred to the Event Organiser where appropriate.Naughty Goblin Events may remove or suspend an event listing where there are reasonable concerns about fraud, legality, safety, inaccurate information, non-compliance or material risk to Customers or the platform.
- 8. Event Changes, Postponements and Cancellations
- Events may occasionally be changed, postponed or cancelled. Customer rights and refund entitlements are dealt with under our separate Refund & Cancellation Policy and applicable South African law.A reasonable change to an event programme, performer, schedule or layout will not automatically create a right to a refund. Material changes will be assessed in accordance with the circumstances and applicable consumer law.
- 9. Customer Cancellations and Refunds
- Customer cancellation and refund requests are governed by our separate Refund & Cancellation Policy and applicable South African consumer law. Where a reasonable cancellation charge is legally permitted, it may take account of factors such as the timing of cancellation, the nature of the booking and the reasonable possibility of reselling the Ticket.Nothing in these Terms is intended to waive a Customer's rights under the Consumer Protection Act or other rights that cannot lawfully be excluded.
- 10. Admission and Event Rules
- A valid Ticket is required for admission unless the Event Organiser has authorised another method of entry. Attendees must comply with lawful venue and event rules and reasonable instructions from authorised event or venue personnel.Admission may be refused, or an attendee may be removed, where reasonably justified by fraud, safety or security concerns, serious misconduct, failure to satisfy an advertised age or identification requirement, or a material breach of applicable event rules.Any unusual or significant risk, indemnity, assumption of risk or limitation that South African law requires to be specifically brought to a consumer's attention must be separately and conspicuously disclosed where applicable.
- 11. Ticket Transfers and Resale
- A Ticket may only be transferred or resold where the applicable event and Naughty Goblin Events permit it. Where an authorised transfer facility is provided, Customers should use that facility.We cannot guarantee the validity of Tickets bought from unauthorised sellers or transferred outside an approved process.
- 12. PiP, Check-in Consoles and Check-in Apps
- Naughty Goblin Events may provide PiP, Check-in Consoles, mobile check-in applications, scanners and related technology to Event Organisers and authorised event personnel.· These services may validate Tickets, record check-in status and assist with event admission.· Organiser and staff functions may be limited to authorised users, accounts, devices or credentials.· Users may not interfere with, bypass, manipulate, reverse engineer or misuse these services except to the extent that a restriction is prohibited by law.· A temporary network, power, device, scanner or service failure does not by itself determine whether a Customer holds a valid Ticket. Reasonable alternative verification may be used where available.We may maintain, update, suspend or withdraw a connected service where reasonably necessary for security, maintenance or operational reasons.
- 13. Merchandise
- Where merchandise is sold through Naughty Goblin Events, the applicable description, price and availability will be displayed at the time of purchase. Product images are illustrative and reasonable variations in colour, packaging or appearance may occur.Delivery, defective goods, returns, exchanges and merchandise refunds are governed by our Refund & Cancellation Policy and applicable South African consumer law.
- 14. Electronic Communications
- Transactional communications, including booking confirmations, Tickets, payment notices, security messages, event updates and service notices, may be sent electronically to the contact details supplied by the Customer.Marketing communications are handled in accordance with our Privacy Policy and applicable law, and marketing consent may be withdrawn using the available unsubscribe mechanism.
- 15. Privacy
- Personal information is processed in accordance with our separate Privacy Policy and applicable South African data-protection law. This includes information processed through the website, ticketing system, PiP, Check-in Consoles, check-in apps and related services.
- 16. Intellectual Property
- The Naughty Goblin Events name, platform, software, original graphics, layouts, branding and original content are protected by applicable intellectual-property laws. Event Organisers and other third parties retain ownership of content belonging to them.You may not unlawfully copy, distribute, commercially exploit, scrape, interfere with or create unauthorised derivative works from protected platform content or software.
- 17. Acceptable Use and Security
- · Do not attempt to gain unauthorised access to accounts, administrative functions, databases or connected services.· Do not introduce malicious code or deliberately disrupt the platform.· Do not use the platform for fraud, impersonation or manipulation of Tickets or check-in records.· Security concerns may be reported to support@naughtygoblinevents.com.
- 18. Third-Party Services
- The platform may use third-party payment processors, hosting providers, email services, couriers and other suppliers. Their own terms and privacy practices may apply to the services they provide.We take reasonable care when integrating third-party services but cannot guarantee the continuous availability of systems outside our control.
- 19. Platform Availability
- We take reasonable steps to keep Naughty Goblin Events and its connected services secure and available. Continuous or error-free operation cannot be guaranteed. Maintenance, internet failures, third-party outages, cyber incidents, power failures and other circumstances beyond reasonable control may cause temporary interruptions.
- 20. Liability
- To the maximum extent permitted by South African law, Naughty Goblin Events is not responsible for indirect or consequential loss caused solely by circumstances outside its reasonable control, or for the independent acts or omissions of a third-party Event Organiser where Naughty Goblin Events is acting only as the ticketing and technology platform.Nothing in these Terms excludes or restricts liability, remedies or consumer rights that cannot lawfully be excluded or restricted.
- 21. Circumstances Beyond Reasonable Control
- Where an event or service is affected by circumstances genuinely beyond reasonable control, the parties' rights and obligations will be determined by the circumstances, the Refund & Cancellation Policy and applicable South African law.
- 22. Changes to These Terms
- We may update these Terms when reasonably necessary to reflect changes to the platform, services, law or business operations. The current version will display its effective date. Changes will not retrospectively remove rights that have already accrued to a Customer.
- 23. Governing Law and Disputes
- These Terms are governed by the laws of the Republic of South Africa. Nothing in these Terms prevents a consumer from approaching a competent consumer body, ombud, tribunal or court where entitled to do so under applicable law.
